General Terms and Conditions
for the use of the VERD.cash payment card
1. introduction
These General Terms and Conditions ("GTC") govern the use of the prepaid card (hereinafter"card") and apply between you (hereinafter"user" and/or "user") and VERD Finanzas AG (CHE-205.156.024) (hereinafter"issuer"). By accepting these GTC online, you declare your agreement with their content.
2. cardholder
2.1 The card may only be ordered by persons of legal age (18 years or older) and/or by persons with parental authority for their children.
2.2 The card may only be ordered and used by persons domiciled in Switzerland.
2.3 A prerequisite for using the card is successful registration via the VERD.cash website or app and the provision of the requested information. The issuer reserves the right to request additional information at any time in order to fulfill regulatory requirements.
2.4 The user confirms that he or she is the sole beneficial owner of the assets held in the card account. The user is obliged to keep the issuer up to date at all times with the information he/she has provided to the issuer, in particular his/her name and address, and to notify the issuer of any changes without being requested to do so and without delay.
2.5 The number of cards per user is limited to one card.
2.6 The issuer reserves the right to reject registration applications without stating reasons or to cancel registrations that have already been made.
3. use of the card
3.1 The card is a prepaid product and the card account must be topped up with credit in Swiss francs (CHF) before use. The user undertakes to use the card only to the extent of the available credit on the card account, and the prepaid card may only be used for the future purchase of goods or services.
3.2 The card can be used for payments at accepted merchants with the corresponding VERD.cash logo, provided that there is sufficient credit on the card account; the use of the card for illegal purposes is prohibited.
3.3 The possible uses of the card can be adjusted by the issuer at any time, but in any case the card can only be used to purchase goods and services in the future. the amount of the credit corresponds to the amount paid in, less any fees and commissions and transactions already carried out.
3.4 Each card issued remains the property of the issuer.
4. charging and validity
4.1 The card account may only be topped up to the debit of an account in the name of the user at a bank authorized in Switzerland.
4.2 The maximum credit balance is set by the issuer and may be changed at any time, in particular for regulatory and security reasons. At present, the maximum credit balance on the card is CHF 3,000. A maximum of CHF 5,000 per month and CHF 25,000 per year can be loaded onto the card and used for payments.
4.3 The credit is valid indefinitely. The VERD.cash card has no expiration date.
4.4 The user is responsible for monitoring the credit balance and can check this at any time on his/her card account via the website/app.
4.5 No interest is paid on the credit balance.
4.6 If credit is erroneously credited to the user's card account or if there are doubts as to whether credits were correctly made, the user is obliged to inform the issuer immediately. Without the prior consent of the issuer, the user must refrain from any further actions and dispositions in relation to such credits. The user is obliged to transfer the incorrect credits back to the account specified by the issuer. The Issuer is entitled at any time to reverse transactions that were made or authorized in error or due to a technical error.
5. fees
5.1 The card has neither an annual fee nor a top-up fee. However, depending on the selected deposit method, fees may be charged by banks or other providers.
5.2 The Issuer reserves the right to charge fees and commissions for the card and its use; these fees and commissions are communicated in an appropriate manner together with the card application and can be accessed on the website . Changes to the fees and/or commissions are possible at any time due to changes in market conditions. They will be announced in an appropriate manner.
6. loss or theft
6.1 In the event of loss, theft or misuse of the card, the user is obliged to report this immediately to the issuer or to block the card online.
6.2 The Issuer shall not be liable for losses incurred prior to the blocking. The user must contribute to minimizing the damage.
7 Duties of care, responsibility and liability
7.1 The user is liable for all transactions carried out with the card.
7.2 The user must store the card carefully. He or she must know where his or her card is located and regularly check whether it is still in his or her possession. If there is reason to believe that an unauthorized person is in possession of the card, it must be reclaimed immediately.
7.3 Disputes regarding discrepancies and complaints about goods or services as well as claims arising therefrom must be settled by the user directly with the respective merchant accepting the goods or services.
7.4 The Issuer accepts no liability for losses caused by improper use of the card or for losses incurred before the card was blocked.
7.5 The Issuer shall not be liable if an accepted merchant does not accept the card as a means of payment or if the card cannot be used for technical reasons.
7.6 The liability of the publisher for consequential damages, loss of profit and loss of data is, as far as legally permissible, excluded in any case.
8. data protection
8.1 The Issuer collects and processes the User's personal data in accordance with the applicable data protection provisions of Switzerland.
8.2 The data is used exclusively for payment processing.

9. blocking and termination
9.1 The Issuer may block the card at any time without giving reasons. The user may request that the card be blocked at any time. Both the user and the issuer may terminate the contractual relationship in writing at any time.
9.2 Upon termination, any remaining balance will be paid out exclusively to an account in the name of the user at a bank authorized in Switzerland. The issuer reserves the right to deduct any costs incurred as a result of misuse of the card. Any use of the card that violates these GTC constitutes misuse.
10 Amendments to the terms and conditions and other provisions
10.1 In justified cases, the Issuer shall have the right to amend the GTC at any time and to announce this in an appropriate manner. In the absence of a written objection within one month of notification, but in any case with the first use of the card, the changes shall be deemed to have been approved by the user. In the event of an objection, the user is free to cancel the card with immediate effect before the changes come into force. Special agreements remain reserved.
10.2 Should a provision of these GTC be partially or completely invalid, the validity of the remaining provisions shall remain unaffected.
11 Applicable law
These GTC are subject to Swiss substantive law. The exclusive place of jurisdiction for all proceedings is Bern or the location of the account-holding office. Mandatory legal jurisdictions remain reserved.
